These Terms and Conditions (the “Agreement”) are entered into between Elaine Duffus (“the Coach”) and the individual or organization (“the Client”) receiving services. By booking a session or engaging in any services provided by the Coach, the Client agrees to be bound by these terms.
1. Services Provided The Coach provides specialist mentoring, life coaching, and author support services, including but not limited to:
• Life Coaching: Support for bereavement, domestic abuse recovery, and personal growth.
• Mentoring: Professional and personal guidance for adults, teens, and community organizations.
• Author Support: Writing motivation Only. Services may be delivered in person, via telephone, or through online video conferencing platforms. No editing or publishing guidance will be untaken unless agreed on a separate contract.
2. Coaching Disclaimer. The Client acknowledges and agrees that:
• Life coaching and mentoring are not substitutes for professional mental health care, medical advice, or legal counsel.
• The Coach is not a licensed therapist, counselor, or medical professional.
• The Client is solely responsible for their own decisions, actions, and results arising from the coaching relationship
• The Coach makes no guarantees regarding specific outcomes or results.
3. Fees and Payment.
• Fees for services will be agreed upon at the time of booking or as outlined in a separate proposal.
• Payment is required in advance of the session unless otherwise agreed in writing.
• Payments can be made via [Insert Payment Method, e.g., Bank Transfer/PayPal].
• The Coach reserves the right to adjust fees with reasonable notice to existing Clients.
4. Cancellation and Rescheduling
•Notice Period:
The Client must provide at least 24 hours’ notice to cancel or reschedule a session.
• Late Cancellations:
Cancellations made with less than hours’ notice will be charged at the full session rate.
• Coach Cancellation: In the unlikely event that the Coach needs to cancel a session, a full refund or a rescheduled session will be offered.
5. Confidentiality.
The Coach will maintain the strictest confidentiality regarding all information shared by the Client, except where:
• The Client gives explicit written consent to share information.
• The Coach is legally required to disclose information (e.g., by court order).
• The Coach believes there is a risk of serious harm to the Client or others.
• The Coach discusses the case anonymously with a professional supervisor for the purpose of professional development.
6. Data Protection (GDPR).
The Coach complies with the UK General Data Protection Regulation (UK GDPR).
• Personal data collected (name, contact details, session notes) is used solely for providing services and communication.
• Data is stored securely and will not be shared with third parties without consent, except as required by law.
• The Client has the right to request access to their data or its deletion at any time.
7. Intellectual Property.
All materials, worksheets, and content provided by the Coach remain the intellectual property of Elaine Duffus.
The Client is granted a non-exclusive, non-transferable license to use these materials for personal use only.
8. Limitation of Liability
To the maximum extent permitted by law, the Coach shall not be liable for any indirect, incidental, or Initial Coaching Session Plan.

The Coach’s total liability shall not exceed the total fees paid by the Client for the specific service in question.
9. Termination
Either party may terminate the coaching relationship at any time with written notice.
Any prepaid sessions that have not yet occurred (and meet the cancellation criteria) will be refunded.
10. Governing Law.
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

If any health-related concerns arise during the session, the coach will strongly recommend and may require the coachee to seek professional medical advice from a qualified healthcare provider.
The coach will not provide medical advice or treatment.
Safeguarding Guidelines.
Coaching sessions are conducted in a safe and confidential environment. However, there are circumstances where the coach may need to break confidentiality to ensure the safety and well-being of the coachee or others.
These circumstances include, but are not limited to:
• If the coachee discloses an intention to seriously harm themselves or others.
• If the coachee discloses information about child abuse or neglect.
• If required by law or court order.
In such situations, the coach will endeavor to discuss this with the coachee first, where appropriate, before taking any action.
The coach’s priority is always the safety and well-being of all involved.
